Advertising Terms of Use

 These Jobsquare.ng Service Terms and Conditions  (“Terms”) govern every Advertiser (referred as “You”, “Your”, “Advertiser “or “End User”) that:

 

  • Have accessed the Jobsquare.ng website as an advertiser through www.jobsquare.ng

 

  • Have placed a vacancy advertisement on Jobsquare.ng. 

 

  • Have been advised that every application submitted for the advertised job vacancy will be stored for you on the www.jobsquare.ng website. 

 

  • Have used any of the features or products of Jobsquare.ng on the website. 

Your using and accessing any materials, services, and information on the Jobsquare.ng website is conditional upon your acceptance and compliance with the Terms. 

 

There may be extra terms that govern your working relationship with Jobsquare.ng in addition to these terms based on your selected level of service. 

 

For this agreement the words "Jobsquare", "We", “Us”, and "Our" refer to Jobsquare.ng and "Website" to materials delivered on www.jobsquare.ng.   

The Website belongs to and is operated by Jobsquare.ng referred to as “Jobsquare”, “We”, “Us” and “Our”.

 

Your continued use of this Website will be taken as your acceptance of these Terms.

 

Change of Terms

 

  1. Jobsquare may change these Terms at any time. If Jobsquare changes these Terms, we will notify you by publishing the changed Terms on the Website.

 

  1. You accept that by doing this, Jobsquare has provided you with enough notice of the change to its Terms. 

 

Payment 

 

  1. Every amount owing to Jobsquare must be paid in full before service will be fulfilled.

 

  1. You are obliged to make payment for the services that Jobsquare agrees to offer you not minding if you use or fully used the services. You are also liable to make full payment to Jobsquare if you do not provide Jobsquare with the necessary information and materials to offer the services to you. 

 

  1. Payments using Bank Transfer, Quickteller, Flutterwave, Paystack, or EFT platform depend on the chosen payment method. 

 

  1. Jobsquare may not inform you before disabling your account or give you notice when they will stop providing you with services if you don’t pay for services offered on time. 

 

  1. You accept and agree that Jobsquare may disclose this information to a credit reporting company or other interested people. 

 

Intellectual Property Rights

 

  1. Jobsquare retains every intellectual property right subsisting in every service offered to you by Jobsquare.

 

Limitation of Liability 

 

  1. Jobsquare does not offer any warranty to you that available services on the Website will be free from error/virus or uninterrupted. Except where Jobsquare is not able to exclude its liability by legislation, we and our employees, agents, contractors, and officers will not be liable to you for any damage or loss. You agree that using the service is at your own risk and can expose you to information and content from different sources. However, it arises (whether in negligence or contract) out of or in connection with you accessing and using the Website. 

 

  1. When it comes to the services offered through the Website, liability for breaching implied terms that legislation cannot exclude is limited at our option to the offering of services again or paying for the services offered again. 

 

  1. Our disclaimer or limitation of liability under these Terms applies to consequential, punitive, direct, indirect, specific, or other damages for loss of information, business interruption, or loss of profit even if Jobsquare is informed of their possibility. 

 

  1. Jobsquare accepts no liability or responsibility for an error in your job advertisements and you must crosscheck your job advertisements for errors immediately after you place them on the Website. 

 

  1. Jobsquare does not guarantee the files you may download on the Website or send through email will be free from viruses, Trojan horses, worms, or other destructive code. It is your responsibility to implement safety procedures to satisfy your specific requirements for correct data input and output and to maintain an external means to the Website for any lost data reconstruction. 

 

  1. Jobsquare agrees to the use of good efforts in publishing job ads in the shortest time. 

 

  1. Jobsquare acts as a platform for job seekers to get job opportunities and is not responsible for betting jobseekers or the representations made by the jobseekers in writing or oral – including the representations that appear on the CV of jobseekers. 

 

Changes to the Website 

 

  1. Jobsquare has the right to change the website functionality, services, and their appearance on the Website without the need to inform or notify you including but not limited to job advertisements on the Website as they are displayed on different mobile communication devices. 

 

What you are to do

 

You agree and warrant that:

 

  1. You have the legal power and authority to agree to do and be bound to these Terms. 

 

  1. You will not initiate any activities or use any technologies that may cause harm to the service, property, and interest of the service users. 

 

  1. Not post or distribute spam, pyramid schemes, chain letters, or viruses. 

 

  1. Do not breach the intellectual property rights of any third party with the job advertisements posted on the Website. 

 

  1. You will not submit misleading, offensive, abusive unlawful, pornographic, libelous, harassing, or otherwise inappropriate data. 

 

  1. Every file uploaded and sent to Jobsquare will be error/virus free. 

 

  1. You will not use the Website for any illegal purpose. 

 

  1. If you obtained data by engaging a third-party provider, or obtained services from the Website on your behalf, you are aware that any breach of these Terms by the third-party provider will be considered a breach of the relevant Terms and Product Terms by you, and Jobsquare has the right to take action against you for the breach even without your involvement or knowledge of the said breach. 

 

  1. You will not transfer or assign these Terms rights and obligations pursuant to any individual or entity without getting written approval from Jobsquare. Any adjustment in your effective control, if you are a company will be deemed an assignment for this clause. 

 

  1. You accept and agree to defend and indemnify Jobsquare and its employees, contractors, officers, and agents against all suits, claims, damages, liabilities, actions, contingent or actual costs, and expenses incurred by Jobsquare in connection with the following:

 

  • Any omission or negligent act by you. 

 

  • Any breach of the Product Terms and these Terms by you. 

 

  • An alleged or actual breach by you of any regulations, ordinances, law, legislation, codes of conduct, or by-laws that occurs as a consequence of your job advertisement appearing on the Website. 

 

  • The listing or proposed listing of any job advertisement by you on the Website or any other related website. 

 

  1. You agree to deal with the services and information accessed from the Website and offered by Jobsquare in a manner that abides with every applicable law of Nigeria and all times or of other important jurisdictions (including, without limitation, copyright laws and privacy). 

 

  1. Not to release any advertising or promotional material or other public document relating to Jobsquare to the public without obtaining written approval from Jobsquare beforehand. 

 

  1. You may not copy, modify, upload, reproduce, transmit, post, republish, or distribute any material (including software and code) from this Website in any way except as otherwise permitted under these Jobsquare Terms. 

 

  1. Not to use any automated systems, robots, data mining, scraping, or automated data publication, extraction, and gathering tool to access, copy, acquire, and monitor this Website. 

 

  1. Not to require or ask any job seeker to pay any money, fee, cost, or charge for job applications on the Website whether such money, fee, cost, or charge while communicating with the jobseeker or in the vacant advertisement placed on the Website. 

 

  1. Only to use management tools and not any features on the Website as a means of communication with the jobseekers based on the Product Terms 

 

Misuse of jobseeker information and on-selling

 

  1. Only you must use the information of any job seeker you obtain from the Website or Services or features of the Website to your genuine hiring processes or genuine employment. 

 

  1. Jobsquare prohibits and considers offering or selling services like educational tools and courses to jobseekers whose information you obtained by accessing the Website or from their job applications. 

 

  1. You must never share the personal information of job seekers you obtained by accessing and using the Website with any party including any related party of yours or an affiliate party unless Jobsquare has given you consent to do so. 

 

  1. Jobsquare is determined in preventing misusing the jobseeker data and reserves the right to do the following if you misuse the personal information of jobseeker obtained from the Website for any reason:

 

  • Immediate termination and suspending your account and a third-party’s account that receives personal information of jobseeker from you in breach of these Terms. 

 

  • Report you to relevant authorities on any potential contravention and take legal action against you in addition to any number of remedies the law provides an award of monetary damages. 

 

Placing Job Advertisements

 

  1. Your job advertisement placed on the Website must comply with every applicable ordinance, legislation, code of conduct, by-law, and regulation and you must keep to the principles of truth in advertising. 

 

  1. You must not insert links to an external website or hosted application form within a company or employer profile, the description of a job advertisement except in the application options, within an externally hosted application form that has been previously approved, and any communications with a jobseeker through Talent Search without the approval of Jobsquare which may be withdrawn or withheld at Jobsquare’s discretion.

 

  1. You must not refer or promote other brands except those related to your business or one by a related party to you within a company or employer profile, the description of a job advertisement except in the application options, within an externally hosted application form that has been previously approved, and any communications with a jobseeker through Talent Search without the approval of Jobsquare which may be withdrawn or withheld at Jobsquare’s discretion.

 

  1. The job advertisement you may post on the  Website must be genuine and one you are currently hiring as of when posted. Jobsquare has the right to ask you to provide any information to verify if the job opportunity is genuine. 

 

  1. The job advertisement you post on the Website must be in the correct category. It is your responsibility to get familiar with the advertising requirements of every category on the Website to have accurate placement of adverts. 

 

  1. Not to post a job advertisement on the Website that the location is outside Nigeria without getting approval from Jobsquare. Jobsquare has the right to charge you the applicable rate for breaching this clause. 

 

  1. You must make sure every piece of information you enter into the advertisement data entry field directly aligns with the data field category. Jobsquare reserves the right to remove, change, or amend, any information that doesn’t meet the requirement. 

 

  1. Every job advert lasts for 90 days. However, you can expire it earlier. 

 

  1. Jobsquare reserves the right and you must accept as a condition to place a job advert on the Website. We have the right to reclassify the job adverts posted on the Website, entitling Jobsquare to take down the job advertisements from one category and republish it on another category of the Website. 

 

  1. Actions such as changing the title, requirements, and description of a job,  constitute a new job advertisement and Jobsquare has the right to invoice you accordingly. 

 

Authority to store and retain job applications

 

  1. You authorize Jobsquare to store and retain every submitted application to a job advertisement on the employer page of Jobsquare instead of emailing the job applications to an external source.

 

Access to the employer page 

 

  1. You are to access the employer zone of Jobsquare with a secure username and password given to you by Jobsquare. Every advertiser is responsible for providing us with the accurate details and identity of persons you have authorized to access the employer page on your behalf, to set authority limits to the persons, and to keep the login details given to the authorized persons safe and confidential. 

 

  1. The usage of the login password given to you by Jobsquare to access the employer page is your responsibility whether you give it to your authorized users or not. Any act performed by your authorized user that is against these Terms is deemed a breach of these Terms by you. 

 

  1. Once you are given access to the employer page by Jobsquare, you can access its functions unless we terminate such access based on the Product Terms or these Terms. 

 

Maintenance

 

  1. We make sure you and your authorized users have access to the employer page at all times. 

 

  1. Nevertheless, maintenance and upkeep of the employer page may be undertaken by us and our third-party service providers. Jobsquare will reduce the downtime period.
